Healthy Thinking is provided by Healthy Thinking Wellness Ltd ("Healthy Thinking", "we", "us" or "our"), a company registered in Scotland under company number SC891947. Our registered office is 36 Kirk Street, Edinburgh, EH6 5EZ.

These terms apply when you create an account, purchase access to, or use the Healthy Thinking app and programme. By doing so, you agree to these terms. If you do not agree to them, please do not use Healthy Thinking.

Healthy Thinking is a self-management platform designed to help people understand and manage stress and nervous-system regulation. The programme currently focuses on people experiencing perimenopause and menopause.

Healthy Thinking provides educational information, guided exercises, coaching content and tools for personal reflection and self-management. It is not a medical or healthcare service and does not diagnose, treat or prevent any medical or mental-health condition.

Healthy Thinking is not a substitute for advice, diagnosis or treatment from a doctor, therapist or other qualified professional. If you have concerns about your physical or mental health, you should seek advice from an appropriate healthcare professional. You should not delay seeking professional advice because of anything you read, hear or experience through Healthy Thinking.

Results vary between individuals. We do not promise that using Healthy Thinking will produce a particular health, wellbeing or personal outcome.

Healthy Thinking is not an emergency or crisis service. If you believe that you or someone else is in immediate danger, call 999 or go to your nearest accident and emergency department. If you are experiencing a mental-health crisis, contact an appropriate crisis service or healthcare professional.

You must be at least 18 years old to create an account or use Healthy Thinking. By creating an account, you confirm that you meet this requirement.

Healthy Thinking is currently intended for people in the United Kingdom. If you access it from another country, you are responsible for ensuring that your use is permitted under the laws that apply to you.

You must provide accurate information when creating your account and keep it reasonably up to date. You are responsible for keeping your login details secure. You must not share your account with another person or allow anyone else to use it. Please contact us promptly if you believe that someone has accessed your account without permission.

We are not responsible for activity on your account caused by your failure to keep your login details secure, unless that activity was also caused by something we did or failed to do.

You agree not to:

• use Healthy Thinking for an unlawful or fraudulent purpose;
• access or attempt to access another person's account or information;
• interfere with, damage or disrupt the app, its security or its supporting systems;
• introduce viruses, malicious code or other harmful material;
• attempt to reverse-engineer the app except where the law expressly permits this;
• copy, record, scrape, reproduce, distribute, sell or commercially exploit the app or its content without our written permission; or
• use Healthy Thinking in a way that infringes another person's rights.

We may suspend or restrict access where we reasonably believe this is necessary to prevent misuse, protect users or systems, or investigate a security issue.

The Healthy Thinking platform and its content, including its programmes, questionnaires, assessments, reports, audio recordings, coaching materials, written content, design, branding and the SAR (Stressors, Amplifiers, Regulators) framework, belong to Healthy Thinking Wellness Ltd or its licensors unless otherwise stated.

While you have access to Healthy Thinking, we give you a limited, personal, non-exclusive and non-transferable right to use the platform and its content for your own non-commercial purposes.

You may not copy, reproduce, record, modify, publish, share, sell, license or redistribute the platform or its content without our written permission, except where the law permits you to do so.

Where you purchase Healthy Thinking directly, the price, access period and anything included in your purchase will be shown before you complete payment.

Unless stated otherwise, prices include any VAT or other applicable taxes.

You must provide complete and accurate payment information. Payments may be processed by a third-party payment provider. We do not normally receive or store your complete payment-card details.

If access is sold as a subscription, the price, billing frequency, renewal arrangements and method of cancelling the subscription will be clearly displayed before purchase. We will not introduce recurring payments unless you have expressly agreed to them.

If your employer, university or another organisation has purchased Healthy Thinking on your behalf, you will not normally be charged personally. Your access may depend on the length and terms of that organisation's arrangement with us.

If you purchase Healthy Thinking online for your personal use, you may cancel your purchase within 14 days of the date the contract is made, without giving a reason.

You may begin using Healthy Thinking immediately. As an additional contractual benefit, we will still provide a full refund if you cancel during the 14-day cancellation period, even if you have already started using the programme.

To cancel, email hellohealthythinking@gmail.com and clearly tell us that you wish to cancel your purchase. You may use the model cancellation wording below, but you do not have to:

"To Healthy Thinking Wellness Ltd: I give notice that I wish to cancel my contract for Healthy Thinking, purchased on [date]. My name is [name] and the email address associated with my account is [email address]."

We will refund the amount you paid using your original payment method, unless we agree otherwise. We will provide the refund without undue delay and no later than 14 days after you tell us that you wish to cancel.

This cancellation right applies to purchases made directly by individual consumers. It does not apply in the same way where access has been purchased by an employer, university or another organisation under a separate commercial agreement.

Nothing in this section affects your statutory rights if the service or digital content is faulty, misdescribed or not provided with reasonable care and skill.

You may be given access to Healthy Thinking free of charge as part of a pilot, evaluation or programme commissioned by an employer, university or another organisation.

Your access may be limited to a particular period, programme or set of features. We will tell you how long your access is expected to last, but free or pilot access does not guarantee continued access after the pilot or evaluation period ends.

We may make reasonable changes to the programme during a pilot, including changes intended to correct errors, improve the participant experience, protect security or support the evaluation of the service.

We may invite you to provide feedback or participate in evaluation activities. We will explain what participation involves, how information will be used and whether participation is optional. Unless we have clearly told you otherwise, you are not required to provide feedback or take part in research or evaluation activities in order to use the programme.

If an organisation has commissioned your access, your use of Healthy Thinking remains subject to these terms. The commissioning organisation does not own your account and does not receive access to your individual responses, health information or progress data. Any reporting provided to it will be aggregated and anonymised as described in our Privacy Policy.

We aim to keep Healthy Thinking secure, accurate and available, but we cannot guarantee that it will always be uninterrupted or free from errors.

We may occasionally suspend access to carry out maintenance, address security issues or make improvements. Where practical, we will try to minimise disruption.

We may update, replace or remove features or content as the programme develops. We will not make a material change that substantially reduces a service you have already paid for without giving you reasonable notice or providing an appropriate remedy.

You are responsible for having a compatible device, suitable internet access and any other equipment needed to use Healthy Thinking. Any relevant technical requirements will be made available before purchase where required.

Our collection and use of personal information is explained in our Privacy Policy, which should be read alongside these terms.

Where an employer, university or another organisation purchases access on your behalf, that organisation does not gain access to your individual account, responses, progress information or health data. It may receive aggregated and anonymised reporting in accordance with our Privacy Policy.

We will provide Healthy Thinking with reasonable care and skill. We do not exclude or limit any responsibility that cannot lawfully be excluded or limited.

Nothing in these terms excludes or limits our responsibility for death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; breach of your statutory consumer rights; or any other matter for which responsibility cannot lawfully be excluded.

If we fail to comply with these terms, we are responsible for loss or damage that is a foreseeable result of that failure or of our failure to use reasonable care and skill. Loss or damage is foreseeable if it was obvious that it might happen or if both you and we knew that it might happen when the contract was made.

We are not responsible for loss or damage that is not foreseeable, for a failure caused by circumstances genuinely outside our reasonable control, or for loss caused by your use of Healthy Thinking in a way that is unlawful or contrary to these terms.

Healthy Thinking is supplied for personal and non-commercial use. We are not responsible for business losses, including loss of profit, revenue, business opportunity or anticipated savings.

We are not responsible for medical or health decisions made contrary to the information in section 2, but this does not exclude responsibility where harm has been caused by our negligence.

You may stop using Healthy Thinking at any time. You may request deletion of your account by contacting hellohealthythinking@gmail.com. Account deletion and the deletion or retention of associated information will be handled in accordance with our Privacy Policy and applicable law.

Cancelling a subscription, ending use of the app and requesting deletion of an account are separate actions. If subscriptions are introduced, the cancellation method and the date on which paid access ends will be explained at the point of purchase.

We may suspend or end your access if you materially or repeatedly breach these terms; you use the service unlawfully or in a way that places another person or our systems at risk; we are required to do so by law; a commissioning organisation's agreed access period ends; or we discontinue Healthy Thinking.

Where appropriate and reasonably possible, we will explain why access has been suspended or ended and give you an opportunity to correct a breach.

If we permanently discontinue a service for which you have paid in advance, we will provide an appropriate refund for the unused portion, unless we ended your access because of your serious or repeated breach of these terms.

Sections intended to continue after access ends, including provisions concerning intellectual property, responsibility and disputes, will remain in effect.

If you have a complaint about Healthy Thinking, please contact us at hellohealthythinking@gmail.com. Please include enough information for us to understand and investigate the issue.

We will acknowledge your complaint and aim to provide a substantive response within a reasonable period.

Nothing in this section prevents you from using any statutory or other dispute-resolution rights available to you.

We may update these terms to reflect changes to Healthy Thinking, the law, regulatory requirements or our business.

If a change materially affects your rights or your use of the service, we will give you reasonable notice by email, through the app or by another appropriate method before it takes effect.

Changes will not apply retrospectively to a completed purchase unless this is required by law or you expressly agree to them.

Each section of these terms operates separately. If a court or other competent authority decides that any section or part of a section is unlawful or unenforceable, the remaining sections will continue in effect.

If we do not immediately enforce a right under these terms, this does not mean that we have waived that right. If we waive a right on one occasion, this does not mean that we will waive it on another occasion.

These terms are between you and Healthy Thinking Wellness Ltd. Unless expressly stated otherwise, no other person has a right to enforce them.

These terms are governed by Scots law.

If you live in Scotland, the Scottish courts will have jurisdiction over disputes relating to these terms. If you live elsewhere in the United Kingdom, you may also be entitled to bring proceedings in the courts of the part of the United Kingdom in which you live.

Nothing in these terms deprives you of any mandatory consumer protection provided by the law that applies where you live.
